DEFINITIONS:

“Agreement” is a reference to these Terms and Conditions, the Privacy Policy, and any order form and payment instructions provided to you. “you”, “Customer” and yours” are references to you, the person accessing this website or Mobile Application and ordering any Goods or Services from the website or Mobile Application or from any other channel provided by Tokiso Company.

“Company”, “We”, “US”, “Our”, “Tokiso.in”, “Tokiso Company” and “Tokiso Enterprises” are references to the Company, which owns and operates the website for the providing of services listed on the web site. We act as an intermediary between you and the service provider. Tokiso Company is an aggregator platform for household services and enables the connection between individuals seeking to obtain services (“Customer”) and/or individuals seeking to provide services (“Service Provider”). Customer and Service Provider together are hereinafter referred to as “Users” and individually as “User”. Those certain services requested by the Customer, which are to be completed by the Service Provider, are hereinafter referred to as “Services”. Service” or Services” shall mean the service of providing the facility of its website for placing the service request provided by the company’s “service provider”, “executive”, “technician” etc. is a third party, which will give services and has further engaged the Company to provide its platform for the services using the website.

Personal Information:

We have limited control over the quality, timing, or legality of Services delivered by Service providers. The company makes only a sincere attempt to provide the best service and hence does not take full responsibility for the suitability, reliability, timeliness, or accuracy of the Services requested and provided by Users. Although we do perform background checks of Service providers, the company cannot confirm that each User is who they claim to be. The company does not assume any responsibility for the accuracy or reliability of this information or any information on the Service.

Transactions, Billing, Payment & Warranty Policy:

The customer offers Service Payments for each requested service. Two days after a service is scheduled, if there is no complaint by the Customer, the service will be marked as closed by the company, and the agreed-upon payment will be transferred to the company’s account. The Service Payment must be paid as instructed by the company. The company has the sole discretion to decide the rates of the parts or services.  Any Service Payments paid outside of the company’s knowledge are NOT subject to refunds. Customers are obligated to pay for the Services unless specifically notified otherwise. Customers are obligated to pay the visiting charges as instructed by the company after a visit has been done by the company executive. Customers can pay using Internet Banking and/or credit/debit cards through Tokiso payment gateway partners or could just pay the Tokiso Service Provider in cash after the Service is completed. Customers can also pay at the end of a completed Service transaction. The company provides a warranty only on certain services or products. The warranty period may vary from product/service accordingly and it will be only as instructed by the company executive. The warranty will be void if any other service provider is involved, the appliance has been shifted to another location, the given warranty period has expired, the appliance has been sold to another user or any external damage has been done. For all purchases and payments for reimbursement costs, fees, or expenses associated with a Service, Company will charge your Bank Account according to the amount agreed upon between you and the company for the use of the Service. Tokiso retains the right, in its sole discretion, to place a hold on any payment for a completed Service transaction. At Tokiso’s sole discretion, refunds or credits may be granted in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by the company. While Tokiso will use commercially reasonable efforts to ensure the security of all banking and other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold Tokiso harmless for any damages that may result there from. Tokiso will use third-party services to process banking information. For further information regarding that Services, please contact the company to request information about the company’s internet banking and other cashless transaction providers. You will be liable for all transaction taxes on the services provided under this Agreement (other than taxes based on company’s income).

CONDUCT: You Agree and Confirm:

You agree not to post, email, host, display, upload, modify, publish, transmit, update or share any information on the Site, or otherwise make available Content: that violates any law or regulation; that is copyrighted or patented, protected by trade secret or trademark, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission or a license from their rightful owner to post the material and to grant Tokiso all of the license rights granted herein; that infringes any of the foregoing intellectual property rights of any party, or is Content that you do not have a right to make available under any law, regulation, contractual or fiduciary relationship(s); that is harmful, abusive, unlawful, threatening, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy or other rights, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or illegal gambling or harms or could harm minors in any way or otherwise unlawful in any manner whatsoever; that harasses, degrades, intimidates or is hateful towards any individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; that threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation; that includes personal or identifying information about another person without that person’s explicit consent; that impersonates any person or entity, including, but not limited to, an Tokiso employee, or falsely states or otherwise misrepresents an affiliation with a person or entity; deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; that is false, deceptive, misleading, deceitful, misinformative, or constitutes “bait and switch” offer; that constitutes or contains “pyramid schemes,” “affiliate marketing,” “link referral code,” “junk mail,” “spam,” “chain letters,” or unsolicited advertisements of a commercial nature; that constitutes or contains any form of advertising or solicitation if (1) posted in areas or categories of the Website which are not designated for such purposes; or (2) e-mailed to Tokiso users who have requested not to be contacted about other services, products or commercial interests; that includes links to commercial services or Third Party Websites, except as specifically allowed by Tokiso; that advertises any illegal services or the sale of any items the sale of which is prohibited or restricted by applicable law, including without limitation items the sale of which is prohibited or regulated by applicable law; that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or any other computer resource; that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to the Service, or that otherwise negatively affects other users’ ability to use the Service; That you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site. You will provide authentic and true information in all instances where such information is requested you. Tokiso reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), it has the right in its sole discretion to reject the registration and debar you from using the Services and / or other affiliated websites without prior intimation whatsoever. That you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site. That before placing a service request you will check the information carefully. By placing a service request you agree to be bound by the terms and conditions of service. You may not use the Site for any of the following purposes:

1. Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
2. Transmitting material that encourages conduct that constitutes a criminal offense or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
3. Gaining unauthorized access to other computer systems.
4. Interfering with any other person’s use or enjoyment of the Site.
5. Breaching any applicable laws;
6. Interfering or disrupting networks or web sites connected to the Site.
7. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

Account, Password and Security:

You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or “Company” for accessing the Service. You are solely and fully responsible for all activities that occur under your password or account. “Company” has no control over the use of any User’s account and expressly disclaims any liability derived therefrom. In case of suspicion that any unauthorized party may be using your password or account or you suspect any other breach of security, you should contact “Company” immediately. All users have to register and login for placing service requests on the site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the user agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in “My Account” or by contacting the customer service.

The Services and our business may change from time to time. As a result, at times it may be necessary for “Tokiso Company” to make changes to this Privacy Policy. Therefore, we may update this privacy policy from time to time (for example, to reflect changes in our business or the law). The Proprietary Material is protected by the domestic and international laws of copyright, patents, and other proprietary rights and laws. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from the website without “Tokiso” prior written consent. You may not use any Meta tags or any other “hidden text” utilizing the Site or Tokiso name or trademarks without the express written consent of Tokiso Company.
